Ex.Brain delivers AI-powered solutions for knowledge continuity, organizational memory, and enterprise operations. Our Services include, but are not limited to:
- Individual ExBrains assigned to users.
- A unified Core Ex.Brain for organizational knowledge.
- Features such as Meeting Organizer, Speech-to-Knowledge (STK), Computer Vision, integrations, and automation agents.
Additional product-specific terms may apply; in case of conflict, those terms prevail.
- You must be at least 18 years old or the age of majority in your jurisdiction to use Ex.Brain.
- You may use the Services only on behalf of a business or organization with proper authorization.
When using Ex.Brain, you agree to:
- Provide accurate and current information during registration.
- Maintain the confidentiality of account credentials.
- Use the Services only for lawful purposes and in compliance with applicable laws.

5. Payment & Subscription
- Ex.Brain is billed on a subscription basis: $25 per user/month (unless otherwise agreed).
- Fees are billed in advance (monthly or annually).
- Payments are non-refundable except as required by law.
- Failure to pay may result in suspension or termination of access.
- Enterprise contracts may include minimum user commitments and negotiated terms.

- We do not train AI models on customer data.
- Each business operates in a logically isolated environment.
- All data is encrypted in transit and at rest.
- Customers retain ownership of their data.

- Customers may use the Services only as authorized under these Terms.
- You may not copy, modify, distribute, or create derivative works without written consent.
8. Service Availability & Disclaimers
- Ex.Brain Services are provided “as is” and “as available.”
- We strive for uptime and reliability but do not guarantee uninterrupted or error-free operation.
- To the maximum extent permitted by law, Ex.Brain disclaims all warranties (express, implied, statutory).
9. Limitation of Liability
To the fullest extent permitted by law:
- Ex.Brain is not liable for indirect, incidental, special, consequential, or punitive damages.
- Ex.Brain’s total liability will not exceed the fees paid by you in the 12 months preceding the claim.
We may suspend or terminate your access immediately if you:
- Violate these Terms.
- Fail to pay subscription fees.
- Engage in fraudulent, abusive, or harmful activities.
Upon termination:
- Your right to use the Services ceases immediately.
- Data may be deleted according to our retention policy.
11. Compliance & Export Controls
You agree not to use Ex.Brain in violation of export control laws, sanctions regulations, or prohibited jurisdictions.
12. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Minnesota, USA (without conflict-of-law principles).
- Any disputes will be resolved exclusively in the state or federal courts located in Minneapolis, Minnesota.
We may update these Terms from time to time. Updates take effect when posted on our website. We will notify customers of material changes. Continued use of Services after changes means you accept the updated Terms.
